Consider the Time Limit on Medical Malpractice Claims

Under current Texas law, health care liability claims, generally, must be filed within two years from the occurrence of the breach of care. Victims of medical malpractice who are minors under the age of 12 shall have until their 14th birthday in which to file a claim. In limited instances, medical malpractice claims may be filed up to 10 years after the date of the breach of duty that gave rise to the health care liability claim.
